Terms of Service
Please read carefully. These Terms cover how orders, payment, cancellations, delivery, and food safety work when you order from Boards & Beyond. By placing an order or paying a deposit, you agree to them.
Pay special attention to Section 07 — Food Safety & Allergens, which is important for you and your guests.
01Agreement to These Terms
These Terms of Service ("Terms") are a binding agreement between you and Boards & Beyond ("Boards & Beyond," "we," "us," or "our"). They apply to our website and to any order you place for our products and services. By submitting an inquiry, confirming an order, or paying a deposit, you confirm that you are at least 18 years old and agree to these Terms. If you do not agree, please do not place an order.
02Our Products & Services
Boards & Beyond creates custom charcuterie boards, grazing tables, individual grazing boxes, dessert and brunch displays, and related sweet creations for clients in Southwest Florida. Every order is made to order. Because our products are handcrafted with fresh, seasonal, and natural ingredients, the final presentation, sizing, and specific items may vary slightly from photos or descriptions, which are illustrative.
03Inquiries, Quotes & Booking
Submitting the inquiry form or contacting us is a request, not a confirmed order. An order is only confirmed once we have agreed on the details in writing (by email or message) and you have paid any required deposit. We recommend reaching out well in advance, as dates and capacity are limited and fill on a first-confirmed basis.
04Pricing, Deposits & Payment
- Prices are based on the agreed product, size, ingredients, guest count, and any delivery or setup services.
- A deposit of [50%] of the total is due to confirm and reserve your date. Deposits are non-refundable except as described in Section 05.
- The remaining balance is due [7 days] before your event or delivery date unless we agree otherwise in writing.
- Accepted payment methods and any applicable sales tax will be confirmed at the time of booking.
- Orders are not finalized, and your date is not held, until the deposit is received.
05Changes, Cancellations & Refunds
Changes
We'll do our best to accommodate changes to your order (guest count, theme, or items) when requested at least [7 days] in advance. Changes may affect pricing and are subject to availability.
Cancellations by you
- Cancellations made [14 days] or more before the event: any payment beyond the non-refundable deposit is refunded.
- Cancellations made fewer than [14 days] before the event: payments are non-refundable, as ingredients, preparation, and the reserved date have been committed.
- The non-refundable deposit may, at our discretion, be applied toward a rescheduled date within [60 days], subject to availability.
Cancellations by us
In the rare event we cannot fulfill a confirmed order (for example, due to illness, emergency, or supply issues), we will notify you as soon as possible and provide a full refund of all amounts paid, including the deposit. This refund is your sole remedy, and we are not responsible for any other costs you may incur.
06Delivery, Pickup & Setup
- Delivery, pickup, and on-site setup options and fees are confirmed at booking and depend on your location within Southwest Florida.
- For setup and grazing-table services, you are responsible for providing a suitable, level, clean, and accessible space, along with table access and power if required.
- You or an authorized representative must be present to receive the order at the agreed time. Once an order is delivered, picked up, or set up and accepted, responsibility for its care, storage, and serving passes to you.
- We are not responsible for delays or issues caused by inaccurate delivery details, venue restrictions, weather, or other circumstances beyond our reasonable control.
07Food Safety & Allergens
This section is important. Please share it with your guests as needed.
- Allergens: Our products are prepared in a kitchen that handles common allergens, including milk, eggs, tree nuts, peanuts, wheat/gluten, soy, and other ingredients. We cannot guarantee that any item is free from allergens or cross-contact. We are not able to guarantee an allergen-free product.
- Your responsibility: You are responsible for informing us of allergies or dietary restrictions before confirming your order, and for informing your guests about the ingredients served. We are not liable for allergic reactions or dietary issues, including where notice was not provided to us.
- Perishable products: Our items are fresh and perishable. They should be kept refrigerated until shortly before serving and consumed within [2 hours] of being left at room temperature, in line with general food-safety guidance.
- After delivery: Once the order has been delivered, picked up, or set up and accepted, you are responsible for proper handling, refrigeration, serving, and storage. We are not responsible for food safety issues arising from improper handling or storage after that point.
08Your Responsibilities
- Provide accurate order, contact, event, and dietary information.
- Make payments by the agreed deadlines.
- Handle, store, serve, and consume the products safely after they are in your care.
- Ensure a safe and accessible environment for any delivery or on-site setup.
09Photography & Intellectual Property
We may photograph or film our products before delivery and may use those images and videos to promote Boards & Beyond, including on our website and social media. These images do not identify you or your guests. If you prefer that we not use images of your specific order, let us know in writing before your event.
All content on this website — including text, designs, logos, and images — is owned by Boards & Beyond or its licensors and may not be copied or reused without written permission.
10Limitation of Liability
To the fullest extent permitted by law, Boards & Beyond's total liability for any claim arising out of or relating to an order or these Terms is limited to the amount you actually paid for that order. We are not liable for any indirect, incidental, special, or consequential damages, including lost profits, event disruption, or costs of substitute products.
Our products are provided without warranties of any kind beyond those that cannot be excluded under applicable law. Nothing in these Terms limits liability that cannot be limited by law.
11Indemnification
You agree to indemnify and hold harmless Boards & Beyond from any claims, damages, or expenses arising from your misuse of the products, your failure to handle or store them safely after delivery, or your failure to inform us or your guests of allergies or dietary restrictions.
12Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or an order will be handled in the state or federal courts located in [Lee County], Florida, and you agree to that jurisdiction.
13Changes to These Terms
We may update these Terms from time to time. The version in effect when you confirm your order applies to that order. We will revise the "Last updated" date above when changes are made.
